Terms & Conditions + End‑User License (EULA)

3.1 Acceptance

By creating an account, purchasing, or using the Service, you agree to these Terms.

3.2 Eligibility & Account

• You must be 13+.
• Keep your login secure; you’re responsible for activity under your account.
• Provide accurate information and keep it updated.
• Social login (Apple/Google/Facebook) is available; you can disconnect providers in settings where supported.

3.3 Digital Content License (All Rights Reserved)

• Ownership: All Guides and related content are owned by Roamify (Pvt) Ltd. or its licensors and protected by IP laws.
• License grant: Upon purchase, we grant you a personal, limited, revocable, non‑exclusive, non‑transferable license to stream and/or securely download the purchased Guide solely within the Roamify Audio Guides app on devices linked to your account.
• No visible local files: Any download is stored in an encrypted in‑app cache; no standalone audio file is placed in your device’s file system, folders, or downloads.
• Restrictions: You must not copy, rip, extract, record, reproduce, mirror, upload, share, sell, rent, sublicense, publicly perform, or distribute any Guide; attempt to bypass DRM or security; reverse engineer any part of the Service; or use bots/scrapers to access content.
• Device/stream limits: We may limit concurrent streams or device activations to prevent abuse.
• Geo features: Some Guides may include GPS‑based features; ensure device permissions are enabled for full functionality.

3.4 Purchases, Currency, Taxes

• Currency: All prices and charges are in USD or EUR.
• Conversion fees: Your bank or card issuer may apply exchange rates and conversion/FX fees beyond our control.
• Taxes: Prices may exclude taxes/duties where applicable; you’re responsible for any required taxes in your jurisdiction.
• Payment processing: Transactions are handled by third‑party processors; we do not store full card details.
• Receipts: We provide digital receipts via email and/or in‑app.

3.5 Refunds

If you experience any issue accessing, downloading, or listening to a Guide, we will provide a full refund on request, no questions asked. App‑store purchases may be subject to Apple/Google rules.

3.6 Availability; Updates; Changes

We aim for continuous availability but may perform maintenance or face outages. We may update the app or modify/discontinue features or content. If a material change impacts purchased content, we’ll make reasonable efforts to preserve access or provide a fair remedy (e.g., refund).

3.7 Acceptable Use

You agree not to:

• (a) interfere with or disrupt the Service;
• (b) attempt unauthorized access;
• (c) upload malware;
• (d) use the Service for unlawful purposes;
• (e) infringe third‑party rights; or
• (f) harvest data from other users.

3.8 Travel & Safety Disclaimer

Guides may reference locations, routes, or opening hours that can change. Always verify critical details with official sources and follow local laws and safety guidance. Use caution when using devices while walking or driving.

3.9 Third‑Party Services

The Service may integrate third‑party SDKs, maps, or links. Those services are governed by their own terms and privacy policies.

3.10 Open‑Source Components

The app may include open‑source software licensed under their respective licenses. Notices are available in‑app or in Annex E.

3.11 IP Claims

If you believe content in the Service infringes your IP, email [IP/Legal Email] with details (work claimed, alleged infringing material, your contact). We will review and respond appropriately.

3.12 Disclaimer; Limitation of Liability

To the fullest extent permitted by law, the Service and Guides are provided “as is” and “as available.” We disclaim implied warranties (merchantability, fitness, non‑infringement). To the extent permitted by law, Roamify (Pvt) Ltd. will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim will not exceed the amount you paid for the relevant Guide in the 12 months before the claim.

3.13 Indemnity

You agree to indemnify and hold harmless Roamify (Pvt) Ltd. from claims arising out of your breach of these Terms or misuse of the Service.

3.14 Termination

We may suspend or terminate access for material breaches or unlawful use. You may stop using the Service anytime. Sections concerning IP, payments, disclaimers, and liability survive termination.

3.15 Governing Law; Dispute Resolution

These Terms are governed by the laws of Sri Lanka. Courts in [Colombo, Sri Lanka] have exclusive jurisdiction, subject to mandatory consumer laws of your country of residence.

3.16 Platform‑Specific Terms

• Apple iOS: Apple is not responsible for support or warranty of the app; Apple and Apple’s subsidiaries are third‑party beneficiaries of these Terms.
• Google Play: Google is not responsible for support or warranty of the app; Google’s terms may also apply.

3.17 Changes to these Terms

We may update these Terms. Continued use after changes take effect signifies acceptance. For material changes, we’ll provide reasonable notice in‑app or by email.
